The following Terms and
Conditions apply to the use of this Web site as well as all transactions
conducted by Silver
Companies.
- Advertising
Terms
1)
Specifically "advertising"
on this sign is not restricted
to Celebrate Virginia's
Central Park and Town
Center businesses and
has to be a registered
business. A "Digital Personal
Message" (DPM) is completely
different and can be
purchased by anyone
of any age (see next item).
2)
A "DPM" is limited to
one screen which can
be up to three lines
but the more lines you
place on a screen the
smaller the message
will be. One line
is the best way to get
your message across.
The following starter
phrases are to be used:
- "Congratulations..."
- "Happy
Birthday..."
- "Happy
Anniversary..."
- "Thank
You..."
- "(Name),
Will You Marry Me?"
- "Happy
Valentines Day..."
- "Happy
Mother's Day..."
- "Happy
Father's Day..."
3)
Other requests may be
offered and will be
considered but all DPM's
will be displayed at
the sole discretion
of the Silver Companies
and/or its agents.
The Silver Companies
and/or its agents
also reserves the right
to edit DPM content
for public display.
Availability for all
DPM's will be limited
to a total of two (2)
per day which includes
weekend runs. It's
based on a first come
first serve basis.
4)
DPM display lengths
will be
5 seconds at a time.
All DPM's will be separated
by other display elements
such as time/date, actual
ads, etc. Every effort
will be taken to separate
DPM's.
5)
Availability for advertising
is limited to approximately
20-40 advertisers per
week. This is to ensure
everyone's ad gets plenty
of cycles per hour to
be effective. The cycle
order and number of
ads will be determined
solely by Silver Companies
and/or its agents. Reasonable
efforts will be made
to keep clients' ads
separated from similar
competitors.
6)
Ads range from 5 to
15 seconds. Depending
on what everyone else
chooses, your ad's/message's
cycle will vary per
hour. (ie: even with
40 advertisers all placing
15 second ads- yours
would cycle approximately
every 10 minutes, 24
hours per day. If 20
advertisers all placed
5 second ads, yours
would cycle approximately
every 1.6 minutes.)
7)
Time and Temperature
may be displayed about
once per minute or two
in between ads at random
and can be even shorter
in time than 60 seconds
depending on the amount
of DPM's and/or ads.
8)
Digital advertisement/message
order placement only
occurs when your payment
is received and your
copy has been submitted
via fax, mail or email. Phone
orders will not be accepted.
9)
Non-profit/community-related/government
agencies are eligible
for reduced rate or
possibly gratis advertising
spots. Each request
is handled on a case-by-case
basis, and no assurances
of acceptance are made
or implied. Priority
is given to those agencies
handling a community
crisis, such as hurricane
relief needs or an emergency
blood drive. These ads
are very limited and
will only be accepted
as paid-openings allow.
Silver Companies and/or its
agents will have the
final judgment of any
non-Central Park advertising
requests. Submit your
Order Form and a letter
of request attached
with pertinent contact
information for consideration.
A general guideline
is that if your non-profit
organization/event charges
an admission or is selling
something (like an auction
or concert), you may
be asked to pay for
your ad. If it is to
promote awareness, all
proceeds for a charity or
is for public safety
(AMBER Alert, storm
warning, parade route),
you may not have to
pay anything.
10)
Any and all political
reference messaging
and/or advertisements
will NOT be eligible
for gratis (free) display(s)
and will be accepted
only under the authorization
and discretion of the
Silver Companies and/or its
agents.
11)
No refunds of any kind
will be offered. A credit
may be issued at the
sole discretion of the
Silver Companies and/or its
agents (see sections
12, 13 & 14).
12)
If a sign malfunction
or power loss occurs
for more than one hour,
a pro-rated credit will
be issued for future
advertising upon the
sign.
13)
Regular and reasonable
sign maintenance, cleaning,
or other service-related
down time is not subject
to service credit as
identified above, unless
it goes beyond four
hours, after which credit
will be issued.
14)
Report any errors on
your ad immediately
to Silver Companies
at (540) 786-1405 so
they can be corrected.
If the error was caused
by our unintentional
error upon entry, credit
will be issued for the
time the ad ran with
the wrong information.
If the error was caused
by you, the client,
no credit will be issued
but the correction will
still be made as soon
as possible.
15)
Any disputes, whatsoever,
arising from an ad placement
or fiduciary contract
for digital advertising
upon the monument sign
of Central Park will
be resolved finally
and forever at the sole
discretion of Silver
Companies and/or its agent. You
waive you and your company's
right to trial by judge,
jury or mediator. Any
claims made will not
exceed the value of
the payment made for
advertising in any case.
16)
For advertising, you
are not required to
offer discounts or free
items/services. However,
we are advising you
that you are more likely
to receive a benefit
from this type of incentive
to respond to your ad.
Keep your sign copy
as short and simple
as possible for maximum
results in any case.
We reserve the right
to abbreviate or omit
letters or words. Every
reasonable effort will
be made to not substantially
change your message.
17)
As always, the first
line of your order will
be the name of your
business only to "grab"
the attention of the
viewers. Subsequent
lines will have the
information you provided
and only three (3) screens
of info per advertiser
is allowed.
For Public Service
Announcements and/or
reduced rates/gratis
ads for non-profit/governmental
agencies, up to all
three screens may be
used for any messaging.
18)
You agree to the following
statements when placing
an ad/message (DPM)
upon this digital monument
sign:

AND SILVER COMPANIES
AND ITS OWNERS AND AGENTS,
HARMLESS FOR ANY CLAIMS

ARISE DIRECTLY OR INDIRECTLY
FROM PLACING AN AD/DPM
ON THIS SIGN. I UNDERSTAND
THAT I AM BOUND BY ALL
LAWS GOVERNING ADVERTISING
CLAIMS, AND THAT BY
PLACING THIS AD/MESSAGE
